Legal
Terms of Service
These Terms of Service govern your use of the AI Safe Cyber mobile application and website. By creating an account or using the service, you agree to these terms. Please read them carefully — we've written them in plain English wherever possible.
Section 01
Acceptance of Terms
By downloading, installing, or using the AI Safe Cyber application or website ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and AI Safe Cyber Pty. Ltd. ("we", "us", or "our"). You must be 18 years of age or older to create an account and use the Service.
If you are using the Service on behalf of another person — for example, assisting a family member — you represent that you have authority to accept these Terms on their behalf.
Section 02
The Service
AI Safe Cyber Pty. Ltd. operates AI Safe Cyber, a cybersecurity awareness platform designed to help everyone identify and respond to digital threats including phishing emails, SMS scams, fraudulent QR codes, and voice fraud.
The Service is built on the Touch Pause Engage (TPE) Situational Awareness Model and includes:
- Interactive training sessions organised around the Amber, Red, and Green modules
- AI-powered session summaries personalised to your performance (Level 1 — Session Intelligence)
- An AI Chat Coach for real-time guidance on suspicious messages (Level 2)
- A Voice Coach for spoken guidance (Level 3 — available as a premium feature in Phase 2)
- A supporting website for account management, subscription, and help resources
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. Where changes materially affect your use of the Service, we will provide reasonable notice.
Section 03
Accounts
Registration
To access the full Service, you must create an account using a valid email address and a password. You agree to provide accurate, current, and complete information at registration and to keep that information up to date.
Account security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@safecyber.app if you suspect unauthorised access to your account.
We will never ask for your password by email, phone, or in-app message. If you receive a communication claiming to be from AI Safe Cyber and requesting your password, treat it as a scam and report it to us.
One account per person
Each account is for use by one individual. Sharing account credentials with others (other than as permitted under the First 500 Users promotional offer, where two users may share access under one subscription) is not permitted.
Section 04
Subscriptions & Billing
Free download
The AI Safe Cyber app is free to download from the Apple App Store. Certain features require an active subscription.
Subscription plans
Subscription plans, pricing, and included features are described on our website at the time of purchase. Subscriptions are billed on a recurring basis (monthly or annually, as selected) and renew automatically unless cancelled.
Payment processing
All payments are processed securely through our third-party payment provider. We do not store your full payment card details. By subscribing, you authorise us to charge your nominated payment method on a recurring basis.
First 500 Users offer
The First 500 Users promotional offer provides two users with access at the price of one subscription. This offer is limited to the first 500 subscriber accounts and is not transferable. The offer closes automatically once the limit is reached and cannot be applied retrospectively.
Cancellation and refunds
You may cancel your subscription at any time through your account settings on our website. Cancellation takes effect at the end of the current billing period — you will retain access until then. We do not offer partial refunds for unused portions of a billing period, except where required by Australian Consumer Law.
Price changes
We may change subscription pricing from time to time. We will give you at least 30 days' notice of any price increase before it applies to your subscription. Continued use of the Service after the effective date of a price change constitutes acceptance of the new price.
Australian Consumer Law: Nothing in these Terms limits any rights you may have under the Australian Consumer Law, including consumer guarantees that cannot be excluded by contract.
Section 05
Acceptable Use
You agree to use the Service only for its intended purpose — your own personal cybersecurity education and awareness. You must not:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to reverse engineer, decompile, or extract the source code or underlying AI models of the Service
- Use automated tools, bots, or scripts to access or interact with the Service
- Attempt to gain unauthorised access to any part of the Service, its infrastructure, or other users' accounts
- Transmit any harmful, offensive, or malicious content through any part of the Service
- Reproduce, redistribute, or commercially exploit any content from the Service without our written permission
- Misrepresent your identity or affiliation in connection with your use of the Service
- Use the Service in any way that could damage, disable, or impair our systems or servers
We reserve the right to suspend or terminate your account if we reasonably believe you have violated these requirements.
Section 06
Intellectual Property
Our content
All content within the AI Safe Cyber Service — including but not limited to the Touch Pause Engage framework, training scenarios, AI coaching logic, session summaries, written content, visual design, branding, and software — is the intellectual property of AI Safe Cyber Pty. Ltd. and is protected by Australian and international copyright, trademark, and other intellectual property laws.
The Touch Pause Engage Situational Awareness Model is derived from original doctoral research and constitutes proprietary intellectual property. No part of this framework may be reproduced, adapted, or used in any other product or service without our prior written consent.
Your licence to use the Service
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial use in accordance with these Terms. This licence does not include any right to sublicense, sell, resell, or otherwise commercially exploit the Service or its content.
Your content
Any feedback, suggestions, or ideas you submit to us may be used by us to improve the Service without any obligation to compensate you. We do not claim ownership of the content of messages you send to the AI Coach — that content remains yours.
Section 07
AI Features
The AI Safe Cyber platform includes AI-powered features including personalised session summaries, a Chat Coach, and (in Phase 2) a Voice Coach. By using these features, you acknowledge and agree that:
- AI responses are generated automatically and may not always be perfectly accurate or applicable to your specific situation
- The AI Coach is designed to guide you through the Touch Pause Engage process — it is a support tool, not a substitute for professional cybersecurity advice
- You should not rely solely on AI-generated guidance when making decisions about financial transactions, sharing personal information, or responding to suspected fraud
- If you believe you have been the victim of a scam or cybercrime, you should contact your bank, the Australian Cyber Security Centre (cyber.gov.au), and Scamwatch ( scamwatch.gov.au) directly
Important: The in-app AI Coach is an educational tool. It does not provide legal, financial, or professional security advice. In an emergency, always contact your bank directly using the number on the back of your card, or call 000.
Section 08
Disclaimers
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties — express or implied — regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The Service will be uninterrupted, error-free, or free of viruses or other harmful components
- Any defects in the Service will be corrected
- The Service will meet your specific requirements or expectations
- The results obtained from using the Service will be accurate, complete, or reliable
While we have developed the platform based on peer-reviewed research, completing sessions in AI Safe Cyber does not guarantee that you will identify every scam or cyber threat you encounter in real life. Cybercrime is constantly evolving, and no educational platform can guarantee complete protection.
Section 09
Limitation of Liability
To the fullest extent permitted by applicable law, AI Safe Cyber Pty. Ltd. and its directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Service.
Our total liability to you for any claim arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Australian law.
Section 10
Termination
Termination by you
You may close your account at any time by contacting us at support@safecyber.app or through your account settings. Closing your account cancels any active subscription at the end of the current billing period.
Termination by us
We may suspend or terminate your account immediately and without notice if we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful conduct, or if continued access poses a risk to the security of the Service or other users.
Effect of termination
Upon termination, your right to access and use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, and limitations of liability — will continue to apply.
Section 11
Governing Law
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for the resolution of any disputes arising from or related to these Terms or the Service.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
Section 12
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email and update the "Last updated" date at the top of this page at least 14 days before the changes take effect.
Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and close your account.
